Please read these Terms and Conditions ("Terms") carefully before using the website jamtik.com (the "Website" or "Platform") operated by Jamtik ("we," "us," or "our"). By registering an account, checking the age-confirmation box, uploading videos, or participating in any music competitions on the Website, you formally agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

1. ELIGIBILITY AND AGE RESTRICTIONS

  • Strictly 18+: jamtik.com is intended solely for users who are eighteen (18) years of age or older. By registering an account, checking the age-confirmation box, or submitting User Content, you formally represent and warrant that you are at least 18 years of age and possess the full legal capacity to enter into this binding agreement.

  • Prohibition of Minors: Individuals under the age of 18 are strictly prohibited from creating accounts, uploading video performances, or participating in any competitions on the Website.

  • Falsification of Age & Liability: jamtik.com operates on a good-faith basis and relies on the user's representations. If you falsify your age during registration, you assume all legal and financial liability resulting from this breach of contract.

  • Right to Terminate: If we discover or have reasonable grounds to suspect that a user is under 18, or that a minor appears in a submitted video, we reserve the absolute right to immediately terminate the account, disqualify the submission from any competition, and permanently delete all associated media from our servers without prior notice.

2. REGISTRATION AND SOCIAL MEDIA INTEGRATION

  • Account Accuracy: You agree to provide accurate, current, and complete information during registration. You are solely responsible for keeping your credentials confidential and for all activities that occur under your account.

  • Social Media Integration: The Website allows users to link or list their third-party social media profiles (e.g., Instagram, YouTube, TikTok). By providing these handles, you understand and agree that this information will be made public on your jamtik.com profile.

  • Attribution & Tagging: You grant jamtik.com the right to tag, mention, or hyperlink to your provided social media profiles when we distribute the compiled videos on our official brand channels.

3. USER CONTENT AND LICENSE GRANT

  • Definition: "User Content" refers to any video recordings, audio tracks, musical performances, images, or text that you upload to jamtik.com.

  • Ownership: You retain original ownership and copyrights to the individual performance submitted to the Platform.

  • The Grant of License: By uploading User Content, you grant jamtik.com a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, host, store, stream, reproduce, modify, crop, adapt, edit, mix, and combine your User Content with the performances of other users to create a collective, multi-screen compilation video (the "Final Jam").

  • Distribution Rights: You grant us the absolute right to publish, broadcast, and distribute the Final Jam on our Website and any external social media platforms, including but not limited to YouTube, TikTok, Instagram, Facebook, and other video-hosting or streaming channels.

  • Commercial Use and No Financial Compensation: You explicitly acknowledge and agree that jamtik.com intends to commercially monetize the "Final Jam" compilation videos on all platforms, including through programmatic advertisements, sponsor integrations, creator funds, and paid subscriptions. By submitting your User Content, you agree that your participation is strictly voluntary and promotional. You hereby waive any right to financial compensation, royalties, residuals, performance fees, or revenue-sharing of any kind arising from the commercial exploitation of the Final Jam by jamtik.com.

4. OWNERSHIP OF THE "FINAL JAM"

  • Derivative Work: The Final Jam (the compiled, edited, and mixed video containing multi-user musical sessions mixed by our team) is considered a derivative and composite work.

  • Exclusive Intellectual Property: All rights, titles, and intellectual property interests in the Final Jam belong exclusively to jamtik.com.

  • Prohibition of Unauthorized Distribution: Users are strictly prohibited from downloading, re-editing, slicing, monetizing, or commercially distributing the Final Jam without explicit, prior written consent from the administration of jamtik.com.

5. BACKING TRACKS, COPYRIGHTS, AND WARRANTIES

  • Platform-Provided Audio: jamtik.com provides the official licensed backing tracks for the competitions. You agree to use these tracks solely for creating your submission for jamtik.com. You are prohibited from using the provided backing tracks for any external commercial purposes.

  • Originality of Performance: You represent and warrant that you own or possess all the necessary licenses, rights, and permissions to upload your specific video performance and audio contribution, and that your video does not infringe upon the intellectual property or privacy rights of any third party.

  • Trademark Disclaimer: The appearance of third-party musical equipment, guitar brands, or gear logos in User Content does not imply any affiliation, sponsorship, or endorsement of the competition by those respective brands.

  • Indemnity: You assume all legal and technical risks associated with third-party copyright claims arising directly from your specific performance or setup. jamtik.com is not liable for any third-party claims or video takedowns caused by your submission.

6. CONTENT MODERATION, VOTING, AND SELECTION

  • No Guarantee of Inclusion: Jamtik.com operates under strict artistic and editorial discretion. We do not guarantee that your uploaded video will be selected or included in any Final Jam project.

  • Peer-Voting System: For specific rounds, winners may be determined by the participants themselves through our peer-voting system. Jamtik.com reserves the right to audit votes, eliminate fraudulent activity, and make the final determination in the event of a tie or suspected system manipulation.

  • Removal Rights: We reserve the right to filter, reject, or permanently delete any User Content from our servers without notice if it fails to meet technical quality standards, contains inappropriate, offensive, or hateful imagery, or violates our community guidelines.

7. LIMITATION OF LIABILITY

  • "As Is" Basis: jamtik.com is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

  • No Data Guarantee: We do not guarantee uninterrupted website functionality or that your uploaded media will be permanently backed up. We are not liable for any lost data, software glitches, account platform strikes on third-party channels, or any emotional or financial damages resulting from the use or unavailability of the Website.

8. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. When updates occur, we will adjust the "Last Updated" date at the top of this page. Your continued use of jamtik.com after modifications are published indicates your formal acceptance of the revised Terms.
